{"id":125,"date":"2020-07-17T06:35:07","date_gmt":"2020-07-17T06:35:07","guid":{"rendered":"https:\/\/avp.ro\/?page_id=125"},"modified":"2020-07-30T10:06:10","modified_gmt":"2020-07-30T08:06:10","slug":"principiile-de-la-paris","status":"publish","type":"page","link":"https:\/\/avp.ro\/index.php\/principiile-de-la-paris\/","title":{"rendered":"PRINCIPIILE DE LA PARIS"},"content":{"rendered":"<p style=\"font-weight: 400;\"><strong>Principii referitoare la Statutul Institu\u021biilor Na\u021bionale<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>(Principiile de la Paris)<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>&nbsp;<\/strong><\/p>\n<p style=\"font-weight: 400;\">Adoptate prin Rezolu\u021bia Adun\u0103rii Generale nr. 48\/134 din 20 decembrie 1993<\/p>\n<p style=\"font-weight: 400;\"><strong>Competen\u021be \u0219i responsabilit\u0103\u021bi<\/strong><\/p>\n<ol>\n<li style=\"font-weight: 400;\">O institu\u021bie na\u021bional\u0103 trebuie s\u0103 aib\u0103 competen\u021ba de a promova \u0219i proteja drepturile omului.<\/li>\n<li style=\"font-weight: 400;\">O institu\u021bie na\u021bional\u0103 trebuie s\u0103 aib\u0103 un mandat c\u00e2t mai larg posibil, care s\u0103 fie clar prev\u0103zut \u00eentr-un text constitu\u021bional sau legislativ, preciz\u00e2nd componen\u021ba \u0219i sfera sa de competen\u021b\u0103.<\/li>\n<li style=\"font-weight: 400;\">O institu\u021bie na\u021bional\u0103 trebuie s\u0103 aib\u0103,<em>inter alia<\/em>, urm\u0103toarele responsabilit\u0103\u021bi:<\/li>\n<\/ol>\n<p style=\"font-weight: 400;\">(a) S\u0103 prezinte Guvernului, Parlamentului \u0219i oric\u0103rui alt organ competent, la solicitarea autorit\u0103\u021bilor \u00een cauz\u0103, sau prin exercitarea competen\u021belor sale de a se autosesiza cu privire la o anumit\u0103 problem\u0103, puncte de vedere, recomand\u0103ri, propuneri \u0219i rapoarte cu privire la orice aspect legat de promovarea \u0219i protec\u021bia drepturilor omului; institu\u021bia na\u021bional\u0103 poate decide s\u0103 le publice; aceste puncte de vedere, recomand\u0103ri, propuneri \u0219i rapoarte, precum \u0219i orice prerogativ\u0103 a institu\u021biei na\u021bionale trebuie s\u0103 se refere la urm\u0103toarele domenii:<\/p>\n<p style=\"font-weight: 400;\">(i) Orice prevederi legislative sau administrative, precum \u0219i prevederi referitoare la organiza\u021biile judiciare, menite s\u0103 men\u021bin\u0103 \u0219i s\u0103 extind\u0103 protec\u021bia drepturilor omului; \u00een acest sens, institu\u021bia na\u021bional\u0103 examineaz\u0103 legisla\u021bia \u0219i dispozi\u021biile administrative \u00een vigoare, precum \u0219i proiectele \u0219i propunerile \u0219i formuleaz\u0103 recomand\u0103rile pe care le consider\u0103 adecvate pentru a asigura c\u0103 aceste dispozi\u021bii sunt conforme cu principiile fundamentale ale drepturilor omului; recomand\u0103, dac\u0103 este necesar, adoptarea unei noi legisla\u021bii, modificarea legisla\u021biei \u00een vigoare \u0219i adoptarea sau modificarea m\u0103surilor administrative;<\/p>\n<p style=\"font-weight: 400;\">(ii) Orice situa\u021bie de \u00eenc\u0103lcare a drepturilor omului pe care decide s\u0103 o investigheze;<\/p>\n<p style=\"font-weight: 400;\">(iii) Preg\u0103tirea rapoartelor privind situa\u021bia na\u021bional\u0103 a drepturilor omului \u00een general, precum \u0219i aspecte mai specifice;<\/p>\n<p style=\"font-weight: 400;\">(iv) Atragerea aten\u021biei Guvernului asupra situa\u021biilor din orice parte a \u021b\u0103rii \u00een care drepturile omului sunt \u00eenc\u0103lcate \u0219i propunerea de ini\u021biative pentru a pune cap\u0103t unor astfel de situa\u021bii \u0219i, dac\u0103 este necesar, exprimarea unui punct de vedere cu privire la pozi\u021biile \u0219i reac\u021biile Guvernului;<\/p>\n<p style=\"font-weight: 400;\">(b) S\u0103 promoveze \u0219i s\u0103 asigure armonizarea legisla\u021biei, reglement\u0103rilor \u0219i practicilor na\u021bionale cu instrumentele interna\u021bionale privind drepturile omului la care Statul este parte \u0219i punerea acestora \u00een aplicare efectiv\u0103;<\/p>\n<p style=\"font-weight: 400;\">(c) S\u0103 \u00eencurajeze ratificarea instrumentelor men\u021bionate anterior sau aderarea la aceste instrumente \u0219i s\u0103 asigure punerea lor \u00een aplicare;<\/p>\n<p style=\"font-weight: 400;\">(d) S\u0103 contribuie la rapoartele pe care Statele trebuie s\u0103 le transmit\u0103 organelor \u0219i comisiilor Organiza\u021biei Na\u021biunilor Unite \u0219i institu\u021biilor regionale, \u00een conformitate cu obliga\u021biile care le revin \u00een temeiul tratatelor \u0219i, dac\u0103 este necesar, s\u0103 \u00ee\u0219i exprime opinia cu privire la subiectul \u00een cauz\u0103, cu respectarea independen\u021bei lor;<\/p>\n<p style=\"font-weight: 400;\">(e) S\u0103 coopereze cu Organiza\u021bia Na\u021biunilor Unite \u0219i cu orice alt\u0103 organiza\u021bie din sistemul Organiza\u021biei Na\u021biunilor Unite, cu institu\u021biile regionale \u0219i institu\u021biile na\u021bionale ale altor \u021b\u0103ri, care au competen\u021be \u00een domeniul protec\u021biei \u0219i promov\u0103rii drepturilor omului;<\/p>\n<p style=\"font-weight: 400;\">(f) S\u0103 contribuie la formularea programelor de educa\u021bie \u0219i de cercetare \u00een domeniul drepturilor omului \u0219i s\u0103 participe la punerea acestora \u00een practic\u0103, \u00een \u0219coli, universit\u0103\u021bi \u0219i cercuri profesionale;<\/p>\n<p style=\"font-weight: 400;\">(g) S\u0103 informeze cu privire la drepturile omului \u0219i eforturile de combatere a tuturor formelor de discriminare, \u00een special a discrimin\u0103rii rasiale, prin cre\u0219terea gradului de con\u0219tientizare a opiniei publice, \u00een special prin informare \u0219i educa\u021bie \u0219i prin utilizarea tuturor organelor de pres\u0103.<\/p>\n<p style=\"font-weight: 400;\"><strong>Componen\u021ba \u0219i garan\u021biile independen\u021bei \u0219i pluralismului<\/strong><\/p>\n<ol>\n<li style=\"font-weight: 400;\">Componen\u021ba institu\u021biei na\u021bionale \u0219i numirea membrilor s\u0103i, fie prin alegeri, fie prin alte mijloace, se stabilesc \u00een conformitate cu o procedur\u0103 care ofer\u0103 toate garan\u021biile necesare pentru a asigura reprezentarea pluralist\u0103 a for\u021belor sociale (a societ\u0103\u021bii civile) implicate \u00een protec\u021bia \u0219i promovarea drepturilor omului, \u00een special prin prevederi care s\u0103 permit\u0103 prezen\u021ba sau stabilirea unei cooper\u0103ri eficiente cu reprezentan\u021bii:<\/li>\n<\/ol>\n<p style=\"font-weight: 400;\">(a) Organiza\u021biile neguvernamentale responsabile de drepturile omului \u0219i de combaterea discrimin\u0103rii rasiale, sindicate, organiza\u021bii sociale \u0219i profesionale relevante, de exemplu, asocia\u021bii de avoca\u021bi, medici, jurnali\u0219ti \u0219i oameni de \u0219tiin\u021b\u0103 eminen\u021bi;<\/p>\n<p style=\"font-weight: 400;\">(b) Tendin\u021be \u00een g\u00e2ndirea filosofic\u0103 sau religioas\u0103;<\/p>\n<p style=\"font-weight: 400;\">(c) Universit\u0103\u021bi \u0219i exper\u021bi califica\u021bi;<\/p>\n<p style=\"font-weight: 400;\">(d) Parlamentul;<\/p>\n<p style=\"font-weight: 400;\">(e) Departamente guvernamentale (dac\u0103 acestea sunt incluse, reprezentan\u021bii lor ar trebui s\u0103 participe la deliber\u0103ri numai \u00een calitate de consultan\u021bi).<\/p>\n<ol start=\"2\">\n<li style=\"font-weight: 400;\">Institu\u021bia na\u021bional\u0103 trebuie s\u0103 dispun\u0103 de o infrastructur\u0103 care s\u0103 permit\u0103 buna desf\u0103\u0219urare a activit\u0103\u021bilor sale, \u0219i \u00een special de finan\u021bare adecvat\u0103. Scopul acestei finan\u021b\u0103ri ar trebui s\u0103 fie acela de a asigura personal \u0219i sediu propriu institu\u021biei na\u021bionale, pentru a fi independent\u0103 de Guvern \u0219i a nu fi supus\u0103 controlului financiar care ar putea afecta independen\u021ba acesteia.<\/li>\n<li style=\"font-weight: 400;\">Pentru a asigura un mandat stabil pentru membrii institu\u021biei na\u021bionale, f\u0103r\u0103 de care nu poate exista o independen\u021b\u0103 real\u0103, numirea acestora se efectueaz\u0103 printr-un act oficial care stabile\u0219te durata specific\u0103 a mandatului. Acest mandat poate fi re\u00eennoit, cu condi\u021bia s\u0103 fie asigurat pluralismul \u00een r\u00e2ndul membrilor institu\u021biei.<\/li>\n<\/ol>\n<p style=\"font-weight: 400;\"><strong>Metode de func\u021bionare:<\/strong><\/p>\n<p style=\"font-weight: 400;\">\u00cen cadrul activit\u0103\u021bii sale, institu\u021bia na\u021bional\u0103 poate s\u0103:<\/p>\n<p style=\"font-weight: 400;\">(a) S\u0103 ia \u00een considerare orice aspecte care \u021bin de competen\u021ba sa, fie la sesizarea Guvernului,&nbsp; fie la propunerea unui membru al s\u0103u sau a oric\u0103rui peti\u021bionar, f\u0103r\u0103 a se adresa unei autorit\u0103\u021bi superioare;<\/p>\n<p style=\"font-weight: 400;\">(b) Poate audia orice persoan\u0103 \u0219i ob\u021bine informa\u021biile sau documentele necesare pentru solu\u021bionarea situa\u021biilor care intr\u0103 \u00een sfera de competen\u021b\u0103 a acesteia;<\/p>\n<p style=\"font-weight: 400;\">(c) Se poate adresa opiniei publice direct sau prin intermediul oric\u0103rui organ de pres\u0103, \u00een special \u00een vederea public\u0103rii punctelor de vedere \u0219i recomand\u0103rilor sale;<\/p>\n<p style=\"font-weight: 400;\">(d) Se poate \u00eentruni \u00een mod regulat \u0219i ori de c\u00e2te ori este necesar cu to\u021bi membrii s\u0103i, dup\u0103 ce ace\u0219tia au fost \u00een\u0219tiin\u021ba\u021bi \u00een mod corespunz\u0103tor;<\/p>\n<p style=\"font-weight: 400;\">(e) S\u0103 stabileasc\u0103 grupuri de lucru din r\u00e2ndul membrilor s\u0103i, \u00een func\u021bie de necesita\u021bi, \u0219i s\u0103 \u00eenfiin\u021beze sec\u021bii locale sau regionale care s\u0103 contribuie la \u00eendeplinirea func\u021biilor institu\u0163iei;<\/p>\n<p style=\"font-weight: 400;\">(f) S\u0103 men\u021bin\u0103 consult\u0103ri cu celelalte organe, fie jurisdic\u021bionale sau de alt\u0103 natur\u0103, responsabile pentru promovarea \u0219i protec\u021bia drepturilor omului (\u00een special, ombudsmanii, mediatorii \u0219i institu\u021biile similare);<\/p>\n<p style=\"font-weight: 400;\">(g) Av\u00e2nd \u00een vedere rolul fundamental pe care \u00eel au organiza\u021biile neguvernamentale \u00een extinderea activit\u0103\u021bii institu\u021biilor na\u021bionale, s\u0103 dezvolte rela\u021biile cu organiza\u021biile neguvernamentale dedicate promov\u0103rii \u0219i protej\u0103rii drepturilor omului, dezvolt\u0103rii economice \u0219i sociale, combaterii rasismului,&nbsp; protej\u0103rii grupurilor vulnerabile (\u00een special copiii, lucr\u0103torii migran\u021bi, refugia\u021bii, persoanele cu handicap fizic \u0219i mental) sau domeniilor specializate.<\/p>\n<p style=\"font-weight: 400;\"><strong>Principii suplimentare privind statutul comisiilor cu competen\u021b\u0103 cvasi-jurisdic\u021bional\u0103<\/strong><\/p>\n<p style=\"font-weight: 400;\">O institu\u021bie na\u021bional\u0103 poate fi autorizat\u0103 s\u0103 audieze \u0219i s\u0103 examineze pl\u00e2ngerile \u0219i peti\u021biile referitoare la situa\u021bii individuale. Peti\u021biile pot fi f\u0103cute de c\u0103tre persoane fizice, reprezentan\u021bii acestora, ter\u021bi, organiza\u021bii neguvernamentale, asocia\u021bii ale sindicatelor sau orice alte organiza\u021bii reprezentative. \u00cen astfel de circumstan\u021be \u0219i f\u0103r\u0103 a aduce atingere principiilor enun\u021bate mai sus cu privire la celelalte competen\u021be ale comisiilor, func\u021biile care le-au fost \u00eencredin\u021bate se pot fundamenta pe urm\u0103toarele principii:<\/p>\n<p style=\"font-weight: 400;\">(a) S\u0103 \u00eencerce o solu\u021bionare amiabil\u0103 prin conciliere sau, \u00een limitele prev\u0103zute de lege, prin decizii obligatorii sau, dac\u0103 este necesar, pe baza confiden\u021bialit\u0103\u021bii;<\/p>\n<p style=\"font-weight: 400;\">(b) Informarea p\u0103r\u021bii care a depus peti\u021bia cu privire la drepturile sale, \u00een special la c\u0103ile de atac pe care le are la dispozi\u021bie, precum \u0219i promovarea accesului la acestea;<\/p>\n<p style=\"font-weight: 400;\">(c) Primirea oric\u0103ror pl\u00e2ngeri sau peti\u021bii sau transmiterea acestora oric\u0103rei alte autorit\u0103\u021bi competente \u00een limitele prev\u0103zute de lege;<\/p>\n<p style=\"font-weight: 400;\">(d) Emiterea de recomand\u0103ri autorit\u0103\u021bilor competente, \u00een special prin propunerea de amendamente sau reforme ale legilor, reglement\u0103rilor \u0219i practicilor administrative, mai ales dac\u0103 acestea au creat dificult\u0103\u021bile \u00eent\u00e2mpinate de persoanele care depun peti\u021bii pentru a-\u0219i putea exercita drepturile.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Principii referitoare la Statutul Institu\u021biilor Na\u021bionale (Principiile de la Paris) &nbsp;
