ADMINISTRATIV \u015eI JURIDIC <\/strong><\/span><\/p>\n<p style=\"padding-left: 40px;\">Avocatul Poporului coordoneaz\u0103 direct activitatea \u00een domeniul controlului de constitu\u021bionalitate al legilor \u0219i ordonan\u021belor Guvernului (simple sau de urgen\u021b\u0103), al unific\u0103rii practicii judiciare \u0219i al contenciosului administrativ, care se realizeaz\u0103 prin intermediul Biroului contencios constitu\u0163ional, recurs \u00een interesul legii \u0219i al Biroului contencios administrativ \u015fi juridic.<\/p>\n<p style=\"padding-left: 40px;\"><strong><em>\u00a0<\/em><\/strong><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"color: #3099c2;\"><strong><em>A.Biroul contencios constitu\u0163ional \u015fi recurs \u00een interesul legii <\/em><\/strong><\/span><\/p>\n<p style=\"padding-left: 40px;\">\u00cen cadrul activit\u0103\u021bii de analiz\u0103 a constitu\u021bionalit\u0103\u021bii actelor normative sau a practicii judiciare sunt abordate aspecte ce apar\u021bin tuturor ramurilor dreptului: constitu\u0163ional; administrativ; muncii \u0219i protec\u021biei sociale; mediului; financiar; comercial; civil; penal; procesual civil; procesual penal; drept comunitar \u0219.a.<\/p>\n<p style=\"padding-left: 40px;\"><strong><em>\u00a0<\/em><\/strong><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"color: #3099c2;\"><strong><em>A1. <u>Controlul de constitu\u021bionalitate<\/u><\/em><\/strong><\/span><\/p>\n<p style=\"padding-left: 40px;\"><strong>Avocatul Poporului are exclusivitate \u00een privin\u021ba deciziei de a sesiza sau nu Curtea Constitu\u021bional\u0103 cu o excep\u021bie de neconstitu\u021bionalitate, neput\u00e2nd fi obligat sau \u00eempiedicat de nicio autoritate public\u0103 s\u0103 ridice o atare excep\u021bie.<\/strong><\/p>\n<p style=\"padding-left: 40px;\">Avocatul Poporului se poate implica \u00een controlul de constitu\u0163ionalitate a legilor \u015fi ordonan\u0163elor, realizat \u00een Rom\u00e2nia de c\u0103tre Curtea Constitu\u0163ional\u0103, prin urm\u0103toarele modalit\u0103\u021bi:<\/p>\n<ol>\n<li style=\"list-style-type: none;\">\n<ol>\n<li><span style=\"color: #3099c2;\"><strong><em><u>Sesizarea Cur\u021bii Constitu\u0163ionale <\/u><\/em><\/strong><\/span><\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span style=\"color: #3099c2;\"><strong><em>cu obiec\u0163ii de neconstitu\u0163ionalitate privind legile adoptate de Parlament, \u00eenaintea promulg\u0103rii acestora de c\u0103tre Pre\u015fedintele Rom\u00e2niei<\/em><\/strong>,<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\"><span style=\"color: #3099c2;\"><strong><em>Condi\u021biile sesiz\u0103rii<\/em><\/strong><\/span><\/p>\n<p style=\"padding-left: 80px;\">&#8211; Legea s\u0103 ne fi fost transmis\u0103 de c\u0103tre Parlament, cu 5 zile \u00eenainte de a fi trimis\u0103 spre promulgare; iar \u00een cazul \u00een care legea a fost adoptat\u0103 cu procedur\u0103 de urgen\u021b\u0103, termenul este de dou\u0103 zile.<\/p>\n<p style=\"padding-left: 80px;\">-Legea s\u0103 nu fi fost promulgat\u0103 de Pre\u0219edintele Rom\u00e2niei.<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span style=\"color: #3099c2;\"><strong><em>cu excep\u0163ii de neconstitu\u0163ionalitate privind legile \u015fi ordonan\u0163ele \u00een vigoare <\/em><\/strong><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\"><span style=\"color: #3099c2;\"><strong><em>\u00a0Condi\u021biile sesiz\u0103rii<\/em><\/strong><\/span><\/p>\n<p style=\"padding-left: 80px;\">-Avocatul Poporului poate sesiza Curtea Constitu\u021bional\u0103 fie la cererea persoanelor fizice sau juridice, fie din oficiu;<\/p>\n<p style=\"padding-left: 80px;\">-Avocatul Poporului poate declan\u015fa controlul de constitu\u0163ionalitate pe calea excep\u0163iei de neconstitu\u0163ionalitate indiferent de problemele vizate prin aceasta;<\/p>\n<p style=\"padding-left: 80px;\">-Avocatul Poporului poate ridica excep\u021bia de neconstitu\u021bionalitate a unui act normativ care, de\u0219i publicat \u00een Monitorul Oficial al Rom\u00e2niei, Partea I, nu este \u00eenc\u0103 \u00een vigoare datorit\u0103 faptului c\u0103 \u00een textul s\u0103u prevede o dat\u0103 ulterioar\u0103 de intrare \u00een vigoare, \u00eens\u0103, la momentul judec\u0103rii excep\u021biei de neconstitu\u021bionalitate, cerin\u021ba constitu\u021bional\u0103 esen\u021bial\u0103 este aceea ca actul normativ, con\u021bin\u00e2nd solu\u021bia legislativ\u0103 criticat\u0103, s\u0103 fie \u00een vigoare, respectiv s\u0103 <strong>fac\u0103 parte din fondul activ al legisla\u021biei<\/strong>.<\/p>\n<p style=\"padding-left: 40px;\"><span style=\"color: #3099c2;\"><strong><em>Pentru a veni \u00een sprijinul dumneavoastr\u0103 \u00een situa\u021bia \u00een care dori\u021bi formularea de c\u0103tre Avocatul Poporului a unei sesiz\u0103ri de neconstitu\u021bionalitate, facem o serie de PRECIZ\u0102RI IMPORTANTE!<\/em><\/strong><\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><strong>pot face obiectul controlului de constitu\u021bionalitate<\/strong> doar legile, ordonan\u021bele simple \u0219i ordonan\u021bele de urgen\u021b\u0103;<\/li>\n<li><strong>nu pot face obiectul controlului de constitu\u021bionalitate <\/strong>hot\u0103r\u00e2rile Guvernului, regulamentele, ordinele mini\u0219trilor \u0219i orice alte asemenea categorii de acte normative;<\/li>\n<li>\u00cen scopul efectu\u0103rii analizei de constitu\u021bionalitate a actelor normative men\u021bionate, institu\u021bia<strong> Avocatul Poporului poate solicita date suplimentare <\/strong>at\u00e2t de la autorul sesiz\u0103rii c\u00e2t \u0219i de la autorit\u0103\u021bi publice sau speciali\u0219ti din mediul universitar \u0219i academic;<\/li>\n<li>Analiza de constitu\u021bionalitate presupune examinarea contrariet\u0103\u021bii unui act normativ \u00een raport de prevederile Legii fundamentale, prin raportare la jurispruden\u021ba Cur\u021bii Constitu\u021bionale, a Cur\u021bii Europene a Drepturilor Omului, jurispruden\u021ba \u00cenaltei Cur\u021bi de Casa\u021bie \u0219i Justi\u021bie, precum \u0219i realizarea unor activit\u0103\u021bi conexe: analiza evolu\u021biei legislative \u00een domeniul examinat, a procesului legislativ, a avizelor Consiliului Legislativ \u0219i a altor organisme, a notei de fundamentare sau expunerii de motive<\/li>\n<li>\u00een cazul ridic\u0103rii unei excep\u021bii de neconstitu\u021bionalitate de c\u0103tre Avocatul Poporului, Curtea Constitu\u021bional\u0103 nu exercit\u0103 un control de constitu\u021bionalitate concret, care ar putea s\u0103 influen\u021beze fondul litigiului, deoarece sesizarea Avocatului Poporului se face distinct de orice procedur\u0103 judiciar\u0103, iar nu \u00een cadrul unui litigiu aflat pe rolul unei instan\u021be judec\u0103tore\u0219ti;<\/li>\n<li>efectele unei decizii de admitere a unei sesiz\u0103ri formulate de Avocatul Poporului se produc doar pentru viitor;<\/li>\n<li>sesizarea formulat\u0103 de Avocatul Poporului nu suspend\u0103 cauzele aflate pe rolul instan\u021belor de judecat\u0103;<\/li>\n<li>critica de neconstitu\u021bionalitate s\u0103 reprezinte o solicitare de modificare sau completare a cadrului normativ;<\/li>\n<li>\u00een situa\u021bia <strong>peti\u021biilor individuale<\/strong>, r\u0103spunsul va fi comunicat la adresa indicat\u0103 \u00een cuprinsul sesiz\u0103rii formulate, \u00eenso\u021bit de argumentele care fundamenteaz\u0103 decizia Avocatului Poporului de a sesiza sau nu Curtea Constitu\u021bional\u0103.<\/li>\n<li>\u00een cazul <strong>peti\u021biilor colective<\/strong>, r\u0103spunsul \u00eenso\u021bit de argumentele care fundamenteaz\u0103 decizia Avocatului de a sesiza sau nu Curtea Constitu\u021bional\u0103 va fi afi\u0219at pe site-ul institu\u021biei Avocatul Poporului la Sec\u021biunea \u201dR\u0103spunsuri la peti\u021bii colective\u201d.<\/li>\n<li>dac\u0103 \u00een urma analizei de constitu\u021bionalitate, Avocatul Poporului apreciaz\u0103 c\u0103 prevederile legale criticate contravin dispozi\u021biilor din Legea fundamental\u0103, acesta transmite Cur\u021bii Constitu\u021bionale sesizarea de neconstitu\u021bionalitate.<\/li>\n<li>sesizarea de neconstitu\u021bionalitate va fi publicat\u0103 pe site-ul www.avp.ro la sec\u021biunea Contencios constitu\u0163ional.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\"><span style=\"color: #3099c2;\"><strong><em>Ce condi\u021bii de fond trebuie s\u0103 \u00eendeplineasc\u0103 o solicitare de analiz\u0103 a constitu\u021bionalit\u0103\u021bii unei legi \u00eenainte de promulgare sau a unei legi sau ordonan\u021be \u00een vigoare?<\/em><\/strong><\/span><\/p>\n<p style=\"padding-left: 80px;\"><strong>Peti\u021biile<a href=\"#_ftn1\" name=\"_ftnref1\"><sup>[1]<\/sup><\/a><\/strong> prin care se solicit\u0103 sesizarea Cur\u021bii Constitu\u021bionale trebuie s\u0103 cuprind\u0103, pe l\u00e2ng\u0103 datele de identificare ale solicitantului, urm\u0103toarele <u>trei elemente<\/u>:<\/p>\n<ol>\n<li style=\"list-style-type: none;\">\n<ol>\n<li style=\"list-style-type: none;\">\n<ol>\n<li><em> textul legal contestat din punctul de vedere al constitu\u0163ionalit\u0103\u0163ii; <\/em><\/li>\n<li><em> dispozi\u021bia din Constitu\u021bie pretins \u00eenc\u0103lcat\u0103; <\/em><\/li>\n<li><em> motivarea rela\u0163iei de contrarietate existente \u00eentre cele dou\u0103 texte (argumentarea neconstitu\u0163ionalit\u0103\u0163ii textului criticat). Motivele de neconstitu\u021bionalitate pot viza aspecte de ordin formal, care \u021bin de procedura de adoptare\/emitere a actului normativ criticat (motive extrinseci) sau aspecte care vizeaz\u0103 con\u021binutul actului normativ (motive intrinseci)<\/em><\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<ol>\n<li style=\"list-style-type: none;\">\n<ol start=\"2\">\n<li><span style=\"color: #3099c2;\"><strong><em>Formularea, la solicitarea Cur\u021bii Constitu\u021bionale, a punctelor de vedere privind excep\u0163iile de neconstitu\u0163ionalitate a legilor \u015fi ordonan\u0163elor care se refer\u0103 la drepturile \u015fi libert\u0103\u0163ile cet\u0103\u0163enilor<\/em><\/strong><strong><em>.<\/em><\/strong><\/span><\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p style=\"padding-left: 40px;\"><strong><em>\u00a0<\/em><\/strong><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"color: #3099c2;\"><strong><em>A2. <u>Unificarea practicii judiciare<\/u><\/em><\/strong><\/span><\/p>\n<ol>\n<li style=\"list-style-type: none;\">\n<ol>\n<li><span style=\"color: #3099c2;\"><strong><em>Avocatul Poporului poate promova un recurs \u00een interesul legii la \u00cenalta Curte de Casa\u0163ie \u015fi Justi\u0163ie, asupra problemelor de drept care au fost solu\u0163ionate diferit de instan\u0163ele judec\u0103tore\u015fti<\/em><\/strong>.<\/span><\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p style=\"padding-left: 40px;\"><span style=\"color: #3099c2;\"><strong><em>Condi\u021biile sesiz\u0103rii<\/em><\/strong><\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Sesiz\u0103rile adresate Avocatului Poporului trebuie s\u0103 cuprind\u0103:<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ol>\n<li style=\"list-style-type: none;\">\n<ol>\n<li><strong>expunerea problemei de drept;<\/strong><\/li>\n<li><strong>dispozi\u0163iile legale<\/strong> a c\u0103ror interpretare \u015fi aplicare diferit\u0103 au determinat practica judiciar\u0103 neunitar\u0103;<\/li>\n<li><strong>cel pu\u0163in dou\u0103 hot\u0103r\u00e2ri judec\u0103tore\u015fti <u>definitive<\/u> <\/strong><u>din care s\u0103 rezulte interpretarea diferit\u0103 a aceleia\u015fi probleme de drept de c\u0103tre instan\u0163e de judecat\u0103 aflate \u00een circumscrip\u0163iile mai multor cur\u0163i de apel<\/u>, scopul acestei proceduri excep\u0163ionale fiind unificarea practicii <strong><em>la nivelul \u00eentregii \u0163\u0103ri<\/em><\/strong>.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p style=\"padding-left: 40px;\"><span style=\"color: #3099c2;\"><strong><em>PRECIZ\u0102RI IMPORTANTE!<\/em><\/strong><\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Recursul \u00een interesul legii nu este o cale de atac, prin urmare solicit\u0103rile care pun \u00een discu\u021bie nemul\u021bumiri legate de solu\u021biile pronun\u021bate de instan\u021be \u00een propriile dosare vor fi respinse;<\/li>\n<li>Nu pot forma obiectul recursului \u00een interesul legii elementele de fapt ale cauzelor particulare;<\/li>\n<li>Pentru identificarea practicii judiciare neunitare la nivelul \u00eentregii \u021b\u0103ri, formul\u0103m solicit\u0103ri c\u0103tre toate cele 15 Cur\u021bi de apel din \u021bar\u0103;<\/li>\n<li>Dup\u0103 transmiterea de c\u0103tre instan\u021bele sesizate a hot\u0103r\u00e2rilor judec\u0103tore\u0219ti identificate pe rol, toate documentele transmise sunt analizate \u00een vedere identific\u0103rii hot\u0103r\u00e2rilor judec\u0103tore\u0219ti relevante pentru promovarea unui recurs \u00een interesul legii \u00een scopul unific\u0103rii practicii judiciare neunitare;<\/li>\n<li>Dac\u0103 din analiza jurispruden\u021bei relevante rezult\u0103 existen\u021ba unei practici judiciare neunitare la nivelul \u00eentregii \u021b\u0103ri, <strong>Avocatul Poporului sesizeaz\u0103 \u00cenalta Curte de Casa\u021bie \u0219i Justi\u021bie \u00een scopul pronun\u021b\u0103rii unei decizii prin care s\u0103 se asigure interpretarea \u0219i aplicarea unitar\u0103 a legii<\/strong>.<\/li>\n<li>R\u0103spunsul va fi comunicat la adresa indicat\u0103 \u00een cuprinsul sesiz\u0103rii formulate, \u00eenso\u021bit de argumentele care fundamenteaz\u0103 decizia Avocatului Poporului de a sesiza sau nu \u00cenalta Curte de Casa\u021bie \u0219i Justi\u021bie cu un recurs \u00een interesul legii.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ol>\n<li style=\"list-style-type: none;\">\n<ol start=\"2\">\n<li><span style=\"color: #3099c2;\"><strong><em>Dac\u0103 practica judiciar\u0103 neunitar\u0103 se reg\u0103se\u0219te exclusiv la nivelul unei singure cur\u021bi de apel, Avocatul Poporului poate solicita Pre\u0219edintelui cur\u021bii de apel \u00een cauz\u0103 dispunerea m\u0103surilor legale \u00een scopul unific\u0103rii practicii judiciare.<\/em><\/strong><strong><em>\u00a0<\/em><\/strong><\/span><\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p style=\"padding-left: 40px;\"><span style=\"color: #3099c2;\"><strong><em><u>B. Biroul contencios administrativ \u015fi juridic<\/u><\/em><\/strong><\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"color: #3099c2;\"><strong><em>Activitatea \u00een contenciosul administrativ se realizeaz\u0103 \u00een interdependen\u021b\u0103 cu demersurile Avocatului Poporului efectuate prin intermediul domeniilor sale de activitate specializate.<\/em><\/strong><\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Sesizarea instan\u021bei de contencios administrativ poate fi dispus\u0103 \u00een urma controlului prealabil realizat de c\u0103tre Domeniile de activitate specializate ale Avocatului Poporului \u0219i numai dac\u0103 se apreciaz\u0103 c\u0103 ilegalitatea unui act administrativ sau refuzul unei autorit\u0103\u021bi administrative de a-\u0219i realiza atribu\u021biile legale pot fi \u00eenl\u0103turate doar prin justi\u021bie.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\"><span style=\"color: #3099c2;\"><strong><em>Sesizarea instan\u021bei de contencios administrativ presupune urm\u0103toarele etape:<\/em><\/strong><\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Verificarea dosarului transmis de c\u0103tre domeniile de specialitate \u00een vederea identific\u0103rii actului administrative presupus nelegal sau a refuzului nejustificat al autorit\u0103\u021bii administrative;<\/li>\n<li>Dac\u0103 este cazul, se solicit\u0103 completarea dosarului cu documente necesare formul\u0103rii ac\u021biunii;<\/li>\n<li>Peti\u021bionarul dob\u00e2nde\u0219te de drept calitatea de reclamant, motiv pentru care se solicit\u0103 acordul prealabil al petentului pentru promovarea cererii de chemare \u00een judecat\u0103 de c\u0103tre Avocatul Poporului;<\/li>\n<li>Verificarea \u00eenc\u0103lc\u0103rii unui drept <strong>subiectiv <\/strong>sau a unui\u00a0<strong>interes<\/strong>legitim\u00a0<strong>propriu<\/strong>\u00a0privat al petentului, \u00een vederea sus\u021binerii ac\u021biunii \u00een contencios administrative;<\/li>\n<li>\u00cen cazul \u00een care se constat\u0103 \u00eendeplinite condi\u021biile prev\u0103zute de lege pentru promovarea cererii de chemare \u00een judecat\u0103, se redacteaz\u0103 cererea \u0219i se comunic\u0103 instan\u021bei competente.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\"><em>\u00a0<\/em><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"color: #3099c2;\"><strong><em>PRECIZ\u0102RI IMPORTANTE!<\/em><\/strong><\/span><\/p>\n<p style=\"padding-left: 40px;\">Hot\u0103r\u00e2rile Guvernului nu pot face obiectul controlului \u00een contencios administrativ exercitat prin intermediul institu\u021biei Avocatul Poporului.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"padding-left: 40px;\"><a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> La redactarea peti\u021biei poate fi utilizat<strong><span style=\"color: #3099c2;\"><a style=\"color: #3099c2;\" href=\"https:\/\/avp.ro\/index.php\/cum-sesizez-avocatul-poporului\/formularul-unei-petitii\/\"> formularul orientativ<\/a><\/span><\/strong> ce poate fi accesat pe site-ul institu\u021biei.<\/p>\n<p style=\"padding-left: 40px;\">\n","protected":false},"excerpt":{"rendered":"<p>&nbsp;
