What complaints fall within the competence of the People\u2019s Advocate Institution?<\/strong><\/p>\n

You may submit complaints regarding the administrative acts and deeds of public authorities and the autonomous state management bodies, which violate the rights and freedoms of individuals.<\/p>\n

Are assimilated to administrative acts:<\/p>\n

–\u00a0the silence of the public administration bodies<\/p>\n

–\u00a0the delay in issuing documents<\/p>\n

 <\/p>\n

What complaints do not fall within the competence of the People\u2019s Advocate Institution?\u00a0<\/strong><\/p>\n

Complaints concerning the following acts cannot be subjected to the People\u2019s Advocate Institution and shall be rejected without motivation:<\/p>\n

–\u00a0the acts issued by the Chamber of Deputies, the Senate or by the Parliament<\/p>\n

–\u00a0the acts and deeds of deputies and senators<\/p>\n

–\u00a0the acts and deeds of the President of Romania<\/p>\n

–\u00a0the acts and deeds of the Constitutional Court<\/p>\n

–\u00a0the acts and deeds of the President of the Legislative Council<\/p>\n

–\u00a0the acts and deeds of the judicial authorities<\/p>\n

–\u00a0the acts and deeds of the Government \u2013 except for laws and ordinances.<\/p>\n

 <\/p>\n

What should include a complaint addressed to the People\u2019s Advocate Institution?\u00a0<\/strong><\/p>\n

A complaint shall contain the following elements:<\/p>\n

–\u00a0the name and address of the complainant whose rights and freedoms have been violated<\/p>\n

–\u00a0the rights and freedoms violated<\/p>\n

–\u00a0the name of the administrative authority or the public servant involved<\/p>\n

–\u00a0the proof of the public administration\u2019s delay or refusal to deal with the request according to the law.<\/p>\n

 <\/p>\n

When can I contact the People\u2019s Advocate?\u00a0<\/strong><\/p>\n

Complaints directed against violations of individuals\u2019 rights and freedoms through acts or deeds of the public administrative authorities can be brought to the People\u2019s Advocate Institution no later than one year since the violation took place or the person concerned learned about those facts.<\/p>\n

 <\/p>\n

How can I send a complaint to the People\u2019s Advocate Institution?\u00a0<\/strong><\/p>\n

Complaints must be done in writing.<\/p>\n

Complaints may be sent by:<\/p>\n

–\u00a0mail<\/p>\n

–\u00a0e-mail<\/p>\n

–\u00a0fax<\/p>\n

Or, complaints may be submitted personally or by delegate, to the headquarter registration office or to the territorial offices.<\/p>\n

If the complaints sent by e-mail do not contain complainant\u2019s identification data, these will be requested by e-mail also. If the requested identification data is not provided, the complaint will be considered anonymous.<\/p>\n

If the complaint is submitted by delegate\/proxy, you should mention his\/her identification data.<\/p>\n

For well-grounded reasons, the complainant may make a complaint orally at the premises of our institution, or through the dispatch service\/by phone, which will be put in writing and registered by the person providing the hearing or the dispatcher, as appropriate.<\/p>\n

Where do I send my complaint?<\/strong><\/p>\n

–\u00a0complaints sent by post or brought personally can be submitted at: the headquarters of our institution<\/u><\/strong> or Territorial Offices<\/strong><\/a>.<\/strong><\/p>\n

–\u00a0complaints sent by e-mail:\u00a0<\/strong>petitii@avp.ro<\/strong><\/a><\/p>\n

–\u00a0complaints sent by fax: +\u00a04021 312 49 21<\/em><\/strong><\/p>\n

Do I have to pay a fee in order to address the People\u2019s Advocate Institution?<\/strong><\/p>\n

Submitting a complaint to the People\u2019s Advocate Institution is free of charge.<\/p>\n

Complaints submitted to the People\u2019s Advocate Institution are exempted from stamp tax.<\/p>\n

 <\/p>\n

Could\u00a0the sentenced, arrested or detained<\/strong>\u00a0persons, minors in the re-education centres address the People\u2019s Advocate Institution, in any way, without any restriction?<\/strong><\/p>\n

The administration of\u00a0penitentiaries, re-education centres for minors, of penitentiary hospitals as well as the Public Ministry and the police bodies must allow, with no restriction whatsoever, to anyone who serves imprisonment or is, as the case may be, under arrest or kept in detention, as well as to minors who are in re-education centres, to address to the People\u2019s Advocate in any possible way concerning a violation of their rights and freedoms, except for legal restraints.<\/p>\n

 <\/p>\n

Could the persons performing military duties address the People\u2019s Advocate Institution, in any way, without any restriction?<\/strong><\/p>\n

The same obligation rests with the commanding officers of military units with respect to persons who serve their military duties, regarding infringements upon\u00a0their rights and freedoms, except for legal restraints.<\/p>\n

 <\/p>\n

How can I address the People\u2019s Advocate Institution?<\/strong><\/p>\n

    \n
  1. in writing, by mail, e-mail, fax, or\u00a0complaints may be submitted personally or by delegate, to the headquarters<\/strong>registration office<\/strong>or to the\u00a0territorial offices<\/u><\/strong><\/li>\n
  2. through the\u00a0dispatch<\/u><\/strong>service \/ by phone<\/li>\n
  3. directly, during the\u00a0hearings program<\/u><\/strong><\/li>\n<\/ol>\n

    Hearings are given by the specialized staff of the institution, at the institution headquarters and at the territorial offices.<\/p>\n

    Complainants can be received in audience by the Ombudsperson and her deputies, according to the Regulation on the organization and functioning of the Institution.<\/p>\n

     <\/p>\n

    What happens if I send several complaints which refer to the same problem?<\/strong><\/p>\n

    If a\u00a0person\u00a0addressed\u00a0several\u00a0complaints on\u00a0the same problem, they will be\u00a0joined and\u00a0the complainant\u00a0will receive\u00a0one answer, making\u00a0reference to\u00a0all\u00a0complaints\u00a0received.<\/p>\n

    Repeated complaints\u00a0on the same case\u00a0which\u00a0supply no further evidence\u00a0will\u00a0be archived\u00a0without\u00a0a response\u00a0sent to the complainant.<\/p>\n
